1. Introduction and Purpose

4.3 Harmful, Abusive, and Offensive Content

4.6 Payment and Financial Misuse

  • Providing fraudulent, stolen, or unauthorized payment credentials in connection with any purchase.
  • Initiating chargebacks or payment disputes through financial institutions or payment processors in bad faith, without first completing the dispute resolution process set forth in the Refund and Cancellation Policy and Terms of Service.
  • Attempting to circumvent the Company’s payment systems or to obtain Services without providing valid and authorized payment.
  • Using the Services with the intent to dispute payment after Deliverables have been received and used.

4.7 Confidentiality and Data Misuse

Users are prohibited from misusing Confidential Information or personal data obtained in connection with the Services, including:

  • Disclosing, distributing, or publishing the Company’s Confidential Information, proprietary materials, internal processes, pricing strategies, or client-related information to any third party without express written authorization.
  • Using information obtained through the engagement for purposes outside the scope of the agreed Services.
  • Sharing personal data of third parties with the Company without lawful authority to do so, including providing third-party personal data without appropriate consent or legal basis under applicable data protection law.
  • Attempting to access, collect, or process personal data of other Website visitors or Company clients through any means.

5. User Content Standards

All User Content provided to the Company in connection with a service engagement must meet the following standards:

  • Accuracy: User Content must be accurate, truthful, and not misleading. The User represents and warrants that all information provided to the Company is complete and correct to the best of the User’s knowledge.
  • Lawful Origin: User Content must be owned by the User or the User must have all necessary rights, licenses, and permissions to provide the content to the Company for the purposes of the engagement. Users must not provide content that belongs to a third party without authorization.
  • Non-Infringing: User Content must not infringe the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
  • Non-Harmful: User Content must not promote illegal activity, contain malicious code, include defamatory statements, or otherwise violate the prohibited content standards set forth in Section 4 of this Policy.
  • Compliant with Applicable Law: User Content must comply with all applicable laws and regulations, including data protection laws, advertising standards, and industry-specific regulations relevant to the User’s business.

The Company reserves the right to refuse to use, reproduce, or incorporate any User Content that does not meet these standards, without any obligation to provide a refund for work delayed or refused on this basis if the non-compliant content was provided after services commenced.

6. Use of Deliverables

Deliverables produced by the Company are subject to the intellectual property provisions set forth in the Terms of Service. In addition to those provisions, the following use standards apply:

  • Deliverables must be used only for the lawful business purposes for which they were created, as agreed during the engagement.
  • Deliverables must not be used in any manner that violates applicable advertising standards, consumer protection laws, truth-in-advertising regulations, or any other legal requirement applicable in the jurisdiction where they are published or used.
  • Deliverables must not be materially altered in a manner that changes the fundamental meaning, intent, or tone of the content without the User’s acceptance of full responsibility for the altered content. The Company bears no liability for the consequences of material alterations made by the User after delivery.
  • Deliverables must not be presented or used in a context that could be misleading to consumers, including by pairing Company-produced content with false claims, unsupported statistics, or deceptive framing.
  • Deliverables must not be used to make unsubstantiated health, financial, safety, or performance claims that the User cannot support with credible evidence, regardless of the persuasive intent of the original copy.
  • Deliverables must not be resold, licensed, or transferred to third parties without the prior written consent of the Company, except where such transfer is expressly permitted under the Terms of Service.

7. Reporting Violations

The Company encourages all Users to report potential violations of this Policy to the Company’s attention. The Company does not guarantee any particular outcome or response time for violation reports submitted by third parties.

8. Enforcement and Consequences of Violations

8.1 Company’s Right to Enforce

The Company reserves the right to investigate any suspected or reported violation of this Policy and to take any action it deems appropriate in response, at its sole discretion and without prior notice to the User, except where prior notice is required by applicable law.

8.2 Enforcement Actions

In response to a confirmed or reasonably suspected violation of this Policy, the Company may take any one or more of the following actions:

  • Issue a written warning to the User, requiring immediate cessation of the violating conduct.
  • Suspend the User’s access to the Website and all ongoing Services pending investigation of the alleged violation.
  • Terminate the User’s engagement and all associated Services immediately, without refund for services rendered, in accordance with the termination provisions of the Terms of Service.
  • Remove or refuse to produce any User Content or Deliverable that violates this Policy or applicable law.
  • Report the violation to relevant law enforcement authorities, regulatory bodies, or other appropriate agencies where the violation involves or may involve criminal conduct.
  • Pursue civil legal remedies, including injunctive relief and damages, against Users who have caused harm to the Company or third parties through Prohibited Uses.
  • Disclose User information to law enforcement or regulatory authorities to the extent required or permitted by applicable law.

8.3 No Liability for Enforcement Actions

The Company shall not be liable to any User for any loss, damage, cost, or adverse consequence arising from the Company’s good faith enforcement of this Policy, including the suspension or termination of Services in response to a violation. Users who believe that an enforcement action was taken in error may submit a written appeal to consulting@goldeneyeenterpise.com. The Company will review appeals in good faith within ten (10) business days of receipt.

9. Indemnification for Policy Violations

Any User who violates this Policy agrees to indemnify, defend, and hold harmless Golden Eye Enterprise LLC and its members, managers, officers, employees, contractors, and agents from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from or related to the User’s violation of this Policy, including any third-party claims arising from Prohibited Uses of the Website or Services.

This indemnification obligation is in addition to, and does not limit, any other indemnification obligations set forth in the Terms of Service.

10. Relationship to Other Policies

This Acceptable Use Policy is one component of the Company’s complete legal framework, which also includes the Terms of Service, Privacy Policy, Refund and Cancellation Policy, Cookie Policy, Disclaimer, and Payment and Security page. In the event of any conflict between this Policy and the Terms of Service, the Terms of Service shall prevail.

11. Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles. For Users located in the European Union, mandatory provisions of applicable EU consumer protection law are not affected by this governing law clause and shall continue to apply to the extent required by law.
